This Privacy Statement takes effect on November 1st, 2021.

We care about our partners and know that your privacy is important to you. This Privacy Statement is our way of telling you how we collect your information, why we need it, and how we use it.

About the Influencer Program
The Influencer Program is a program aimed at partnering with Social Media Influencers to share Wayfair or Influencer content for Wayfair marketing purposes. Influencers are selected by Wayfair based on their sharing of Wayfair content on Social Media platforms and other factors. Potential Influencers to be included in the program are discovered on the LoudCrowd platform based on tags, mentions of Wayfair, and content of their Social Media feeds. Potential Influencers are then invited to participate in the program through a variety of emails. Once an Influencer has joined the program, they will have the ability to participate in different campaigns run by Wayfair, producing and/or publishing content, which Wayfair then will repurpose in its own global Social Media channels.

Information We Collect and How We Use Your Information
The information we collect from you either directly or through a third party is set out below.

We use your information in several different ways. What we do with your information depends on when we collect it and what we collect. We may anonymize your information for any purpose permitted by applicable laws.

All Feed Posts tagging @wayfair	The primary value field allows Wayfair to identify and measure the impact of user generated content
Instagram URL	Allows Wayfair to see and approve content
Owner (who posted it)	Connects content with an Influencer so we can give proper credit
Post Date	Determines eligibility of rewards and allows Wayfair to sort content
Likes Count	Used for calculating engagement rate and measuring the quality of content
Comments Count	Used for calculating engagement rate and measuring the quality of content
Caption	Helps Wayfair sort content, identify key themes, and approve content
Email Address	Required to contact Influencer for rewards
Standard email analytics (opens, replies, etc.)	As in your ESP, this allows Wayfair to measure and improve communication

When We Share Your Information
We share your information with the following categories of recipients as an essential part of being able to offer the Influencer Program to you:

• Wayfair affiliates, including Wayfair LLC (Wayfair's parent company) in the USA. We share your information among our affiliates because each is responsible for different Wayfair activities. For example, Wayfair LLC directs and controls our global marketing and customer service activities. We share your information with Wayfair LLC so that we can provide our services to you.
• Professional service providers who help Wayfair run our business, such as marketing companies, software vendors, consultants, and advertising partners.
• Companies approved by you, such as social media sites (if you choose to link your accounts to Wayfair).
• Government and law enforcement agencies, to (i) comply with a legal process, subpoena, order, or other legal or regulatory requirements; (ii) enforce our Terms of Use or other policies; or (iii) pursue available legal remedies or defend legal claims.

We share your information with third parties only as described in this Privacy Statement, with your consent, and as disclosed at the time we collect your information. We may anonymize your information and share such anonymized information with third parties for any purpose permitted by applicable laws.

LoudCrowd Services
In order to be able to offer you the Influencer Program, you will be required to provide a certain set of your personal information (as listed above).
Your personal data is handled in accordance with applicable data protection law and in accordance with the information in LoudCrowd’s privacy policy.

Our Security Measures
We use appropriate technical and organizational safeguards to protect your information from unauthorized use, disclosure, and loss. Transfers Outside of Europe
Wayfair is headquartered in the USA. While Wayfair Stores Limited is an independent entity, its operations, sales, and online presence are closely tied to Wayfair LLC (which is its parent company in the USA). As a result of this relationship, your information will be transferred to the USA to be processed by Wayfair LLC.

Wayfair LLC is a data controller and has committed to complying with this Privacy Statement and European privacy laws with regard to information transferred from Europe. The USA does not have a decision of adequacy from the European Commission, meaning that the laws in the USA may not be as protective as the laws in Europe. Because of this, Wayfair has taken steps to protect your rights when your information is transferred to the USA through the use of the European Commission's Standard Contractual Clauses.
